In a decision announced March 26, 2013, United States District Judge Sean McLaughlin granted the summary judgment motions filed by the Defendants in the case of Maryann Anderson v. Board of School Directors of the Millcreek Township School District, et al.  Maiello, Brungo & Maiello, LLP represented several individual Defendants in the case, which involved allegations by a former Millcreek School District employee, Maryann Anderson, that the District and its former administrative employees violated Anderson’s rights under the Pennsylvania Whistleblower Law and the First Amendment.  Anderson alleged in her suit that her rights were violated by the Defendants after she made certain complaints and statements regarding matters related to the School District’s operations.  In granting the Defendants’ summary judgment motions, the Court found that as a matter of law Anderson had not engaged in any protected speech which gave rise to a compensable claim. It is unknown as of this writing whether an appeal will be filed to the Third Circuit Court of Appeals.
