Sharon M. Menchyk is an attorney with the law firm of Maiello, Brungo and Maiello, LLP. Her practice focuses on commercial matters including litigation and business counseling. Sharon’s litigation experience has covered a wide range of matters including partner and shareholder disputes, non-competition and employment agreement disputes, torts claims, discrimination claims and breach of commercial contract claims. She has also handled a variety of real estate litigation including partition actions and disputes involving agreements of sale and leases.
Sharon had litigated cases both in state and federal court in both jury and nonjury trials. These cases have involved a wide range of civil issues including claims brought by minority shareholders in a construction company, sexual harassment claims on an oil field worksite, a dispute over a distribution agreement involving a multistate territory and a dispute arising out the restructure of a commercial loan. Sharon has also had experience in AAA and private arbitration including claims arising out of a contract for architectural services on a large construction project as well as an equipment supply contract involving multinational parties. After litigating in the trial court, Sharon has had the opportunity to brief and argue matters on appeal to the Pennsylvania Superior Court and the United States Court of Appeals for the Third Circuit receiving favorable decisions for clients.
Sharon also has experience in counseling businesses on a variety of issues from the initial start-up phase through restructuring. Having litigated many commercial issues, she uses that experience to assist clients in the review and drafting of commercial contracts, employment and non-competition agreements and real estate agreements. In the course of working with entities that are either restructuring or acquiring another entity or its assets, Sharon has gained experience representing businesses in bankruptcy and in state court receivership actions.
Sharon is admitted to practice in all Pennsylvania state courts as well as the United States District Courts for the Western and Middle Districts of Pennsylvania and the United States Court of Appeals for the Third Circuit. Her practice has also allowed her to practice in a variety of other states and jurisdictions where she was admitted pro hac vice.
Sharon is a native of Western Pennsylvania and attended the University of Pittsburgh both for her undergraduate degree in Business Management and her Juris Doctorate. She graduated magna cum laude from the University of Pittsburgh School of Law where she was a managing editor for the Journal of Law and Commerce.
Sharon is the author of Pennsylvania Secured Transactions Under Revised Article 9 of the Uniform Commercial Code: Forms and Practice Manual. She is also a founder of Women’s Marketing and Education Network, Inc., which is an organization that provides professional women with the opportunity to learn how to effectively network in order to develop business and become leaders in the business community. Several times a year, Sharon serves as a presenter on real estate topics for continuing legal education classes.
