Transactional Experience
The Banking & Finance Team advises clients in documenting, negotiating and closing different types of loans including commercial real estate and asset-based financing transactions. These transactions involve term loans, development loans, revolving and nonrevolving lines of credit, letters of credit, and equipment leases. Our representation of lenders requires the structuring and documenting of each unique transaction to appropriately secure the identified collateral. We have significant expertise with transactions involving different entities such as partnerships, limited liability companies, corporations and other entities. With a commitment to quality and service, we will identify your needs and effectively address them. We also provide residential loan services, and regularly coordinate and conduct both purchase and refinancing transactions through each aspect of the settlement process.
The Banking & Finance Team provides borrowers with the direction and services needed to successfully close a transaction. We will counsel a client as to what to expect from a transaction and how to structure the transaction to achieve the client's objectives. We will negotiate with the lenders and other participants and document the transaction to best protect the client's interests and goals. Our attorneys and paralegals work to assess the client's needs and achieve results efficiently and economically. Attorneys in our Banking & Finance Team have conducted seminars on commercial loan documentation for lenders and other bank officers addressing issues confronting lenders and borrowers including collateralization and recent statutory changes.
Work Out and Collection
The attorneys in the Banking & Finance Team understand the complex laws and regulations related to foreclosure, collection and bankruptcy in the financial services industry. With our skill, experience and knowledge, we can advise clients regarding troubled loans, structure workout plans for eligible candidates, restructure loan documents, and pursue relief in bankruptcy. When appropriate, on behalf of lenders, we will maximize recoveries on claims against debtors through aggressive exercise of our client's legal rights. We have established an office infrastructure which allows us to handle a significant volume of foreclosure and other like collection actions in a cost-efficient and expedient manner. Collection services range from secured real estate transactions requiring mortgage foreclosures to unsecured commercial and consumer credit collections.
