Roger W. Foley, Jr.
Roger W. Foley, Jr., is the head of the Litigation Team at Maiello, Brungo & Maiello. Throughout his career, Mr. Foley has focused his practice on litigation having successfully tried and settled cases in both federal and state courts throughout Pennsylvania. Mr. Foley has represented corporations and individuals both defending and pursuing claims related to labor and employment disputes, contract disputes, civil rights claims, complex commercial litigation, and personal injury claims. Mr. Foley has successfully litigated cases for over 20 years and has tried numerous cases, including both bench and jury trials.
In addition, Mr. Foley has specialized in the defense of general liability matters. In this regard, he has represented national and regional retail corporations in various premises liability and product liability matters. He has also represented several major corporations in toxic tort defense litigation throughout Pennsylvania and Ohio. Additionally, Mr. Foley has represented various insurance companies in all aspects of insurance defense litigation including complex multi-state class actions. This representation has included the defense of various public entities regarding claims addressed by the Pennsylvania Political Subdivision Tort Claims Act.
Mr. Foley has also served as counsel for various school districts and other public and private employers. In this regard, he has defended claims regarding the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Individuals with Disabilities Education Act, Title VII of Civil Rights Act and the Pennsylvania Whistleblower Law. These claims have also included Section 1983 and other Federal civil rights actions addressing issues associated with procedural and substantive due process, equal protection, absolute and qualified immunity, and state-created dangers.
Mr. Foley is licensed to practice law before all Pennsylvania state courts, the United States District Court for the Western District and Middle District of Pennsylvania, and the United States Court of Appeals for the Third Circuit. He is a member of the Pennsylvania Bar Association and the Allegheny County Bar Association. Mr. Foley has also participated in the American Inns of Court and has guest lectured at The Pennsylvania State University.
Mr. Foley has been recognized as a Pennsylvania Super Lawyer for 2013 in the area of General Litigation. Only five percent of lawyers in Pennsylvania receive this honor through peer recognition and professional achievement.
As a resident of Moon Township, Pennsylvania, with his wife Sara, Mr. Foley enjoys golfing, skiing, hiking and other outdoor activities.
